Pebble Hosted Terms of Service
Last updated: October 29, 2026
Last updated: October 29, 2026
These terms are an agreement between you and Tomek Group LLC, 480 NE 31st St, Unit 1802, Miami, FL 33137, USA ("Pebble", "we", "us"). They cover Pebble Hosted (the "Service"). By ordering or using the Service you agree to them. If you use the Service for an organization, you confirm you can bind it, and "you" means that organization.
1. What the Service is
Pebble Hosted rents you a private, always-on cloud server that runs your Pebble bots. We order the server for you, set it up with the stock Hermes agent software and keep the base system updated. You connect to it from the Pebble apps.
- Each server is a virtual private server (VPS) from OVHcloud in a region you choose or we pick (currently US East, US West or Canada).
- Your connection to the server goes through Cloudflare.
- Your bots use AI models through providers such as Anthropic. Bots can run AI coding tools such as stock Claude Code. You either bring your own provider account or key, or use one that Pebble provides where offered.
The Pebble apps themselves are covered by their own terms.
2. Accounts
- You need a Pebble account to order. Keep your sign-in secure; you are responsible for activity under your account.
- Give us a working email address and keep it current.
- You must be at least 18 years old and able to make a binding contract.
- One person or organization per account. Don't share or resell access unless we agree in writing.
3. Plans, prices and billing
Current plans (USD per month, plus any applicable sales tax):
| Plan | Server | Price |
|---|---|---|
| Starter | VPS-1 | $9 |
| Standard | VPS-2 | $29 |
| Large | VPS-3 | $59 |
| XLarge | VPS-4 | $99 |
- Payment. Stripe processes payments. We don't see or store your full card number.
- Renewal. Plans are monthly subscriptions. They renew automatically each month and charge your payment method until you cancel.
- Tax. Prices are in USD. Sales tax, VAT or GST is added at checkout where it applies, based on your location.
- Worldwide. You can order from any country, except countries where we are legally barred from providing the Service (for example, under sanctions). Servers are currently only in the US and Canada.
- No proration. Plans are billed per full month. We don't prorate partial months, including when you cancel.
- Price changes. We may change prices for future billing periods. We'll email you at least 30 days before a change applies to you. You can cancel before it takes effect. A plan you already bought keeps its price until we notify you of a change.
- Availability. Plans or regions may be sold out or full. We only charge you once we've confirmed we can order your server.
- Failed payments. If a payment fails, we may suspend the Service after a reasonable grace period, and cancel it if it stays unpaid. We'll email you before we suspend.
4. Cancellation and no refunds
- Cancel anytime from the Pebble app. You won't be charged again. Your access continues until the end of the period you've paid for, and then the server is permanently deleted.
- No refunds. Payments are non-refundable, including for partial months and unused time. This doesn't limit any right you have under mandatory consumer law that can't be waived.
- If we can't deliver, you don't pay. If you pay and we then can't order your server (for example, the provider's stock runs out after checkout), we cancel the order and return the full payment automatically. You never had the Service, so this isn't a refund of a service you used.
- Abandoning checkout before you pay costs nothing.
4A. Right of withdrawal (EU, EEA and UK consumers)
If you are a consumer in the EU, EEA or UK, the law normally gives you 14 days after you buy a digital service to withdraw from the contract.
- At checkout we ask you to (1) expressly agree that the Service starts immediately, within the 14 days, and (2) acknowledge that you lose your right of withdrawal once it starts. We set up your server as soon as you pay.
- After you give this consent and acknowledgement and your server starts being provisioned, you can't withdraw for a refund. You can still cancel anytime (Section 4).
- If we start the Service without getting that consent, you keep your 14-day withdrawal right. You can use it by emailing hello@pebble.bot with a clear statement that you want to withdraw.
- We confirm your consent and acknowledgement in your order confirmation email.
5. Your content and your keys
- "Your Content" means everything on your server or sent through your bots: chats, files, instructions, outputs, settings and the AI provider keys or sign-ins you add.
- You own Your Content. You give us only the limited permission we need to run, secure, back up and support the Service.
- Your Content lives on your server. We don't use it to train AI models, and we don't sell it.
- Keys and sign-ins. You add your AI provider keys and sign-ins yourself, on your own server. Keep them secure and within the provider's terms. You pay any charges the provider bills you. If you use a Pebble-provided key, usage limits and any fees we publish apply.
- We may access your server only to provide, secure or repair the Service, when you ask for help, or when the law requires it.
6. Your bots, your responsibility
Pebble bots are AI agents. They can take real actions you direct or allow: run code, browse websites, send messages, change files and use connected accounts.
- You are responsible for what your bots do, as if you did it yourself. That includes instructions you give and actions you let them take on their own.
- Review important actions before relying on them. AI output can be wrong, incomplete or unsafe.
- Give your bots only the access they need. Don't connect accounts or data you aren't allowed to use.
7. Acceptable use
You and your bots must not use the Service to:
- break the law, or infringe anyone's rights, including privacy and intellectual property;
- send spam or unsolicited bulk messages, or run fraud, phishing or scams;
- attack, scan, overload or break into any system you don't own or have permission to test;
- create or spread malware;
- mine cryptocurrency;
- create or share child sexual abuse material, or content that promotes violence or harasses people;
- get around the usage policies of your AI provider, or the rules of websites and services your bots use;
- resell the Service, or interfere with our infrastructure or other customers.
We may suspend a server right away if it is harming others, or if a provider (OVHcloud, Cloudflare, Stripe or an AI provider) requires it. Where we reasonably can, we'll tell you why.
8. Third-party services
The Service relies on providers we don't control, including OVHcloud, Cloudflare, Stripe and your AI providers. Their own terms apply to your use of them, and their outages or changes can affect the Service. We are not responsible for third-party services, or for what AI models generate.
9. Availability and support
- We work to keep your server running, but there is no uptime guarantee or service level agreement (SLA).
- We may do maintenance, apply security updates and restart servers when needed.
- Support is by email at hello@pebble.bot, best effort.
- Backups. Unless a plan says otherwise, keep your own copies of anything important.
10. Export and deletion when you cancel
- Until your paid month ends, your server keeps running, so you can download your files and chats.
- When the paid month ends, the server and everything on it are permanently deleted. We can't recover it afterwards.
- We keep our ordering and billing records as described in the Privacy Policy.
11. Ending the Service
- You can cancel anytime (Section 4).
- We may suspend or end your Service if you materially breach these terms, don't pay, or if we must for legal or security reasons. If we end the Service when you're not at fault, we'll give you reasonable notice where we can and time to export your data.
- We may discontinue Pebble Hosted with at least 30 days' notice. Renewals stop and your access continues until the end of your paid period.
- Sections 5–6 and 12–15 continue after the Service ends.
12. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service or AI output will be error-free, secure or uninterrupted.
13. Limitation of liability
To the extent the law allows:
- Neither side is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data.
- Our total liability for all claims under these terms is limited to the amount you paid us for the Service in the 12 months before the claim arose.
- These limits don't apply where the law doesn't allow them. For example, EU/UK consumers keep their statutory rights for death or personal injury caused by negligence, fraud, and non-conforming digital services.
14. Indemnity
You'll defend and compensate us against third-party claims arising from Your Content, your bots' actions, or your breach of these terms or the law.
15. Governing law and disputes
These terms are governed by the laws of the State of Florida, USA, excluding its conflict-of-law rules. Disputes go to the state or federal courts in Miami-Dade County, Florida. If you are a consumer outside the US (including in the EU, EEA or UK), you keep the protection of the mandatory laws of your country and may bring claims in your local courts. EU consumers can also use the EU's online dispute resolution options.
16. Changes to these terms
We may update these terms. For material changes we'll email you at least 30 days in advance. If you keep using the Service after a change takes effect, you accept it; if you don't agree, cancel before then.
17. General
These terms and the Privacy Policy are the whole agreement for the Service. If a part is unenforceable, the rest still applies. Not enforcing a term is not a waiver. You may not transfer these terms without our consent; we may transfer them as part of a merger or sale of the business. Neither side is liable for delays caused by events beyond its reasonable control.
